REGULATION (EU) No 236/2012 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 14 March 2012 on short selling and certain aspects of credit default swaps regulates the reporting obligations for market participants in the case of short selling of shares and public debt instruments.

It should be noted that the reporting deadlines have been kept very short, the reporting of groups with several entities that are active on the capital market can be considered demanding and the supervisory authorities can impose six-figure fines.

The report must be submitted via Bafin's MVP reporting portal.

In addition, corresponding notifications must also be published in the Federal Gazette.
